Liability Waiver & Hold Harmless Agreement

1. Assumption of Risk

The undersigned ("Renter") acknowledges that the operation of a mobility scooter or any rental equipment provided by Go Rolling Waves (GRW) involves inherent risks, including bodily injury, property damage, or death. BY TAKING POSSESSION OF THE EQUIPMENT, THE RENTER VOLUNTARILY ASSUMES ALL RISKS ASSOCIATED WITH ITS OPERATION, WHETHER KNOWN OR UNKNOWN.

2. Release and Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, THE RENTER HEREBY RELEASES, WAIVES, AND FOREVER DISCHARGES GO ROLLING WAVES, ITS OWNERS, AGENTS, AND EMPLOYEES FROM ANY AND ALL LIABILITY, CLAIMS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO THE RENTAL, USE, OR OPERATION OF THE EQUIPMENT, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF GO ROLLING WAVES.

3. Indemnification

The Renter agrees to indemnify, defend, and hold harmless Go Rolling Waves against any and all legal claims, losses, costs, or attorney fees arising from operator use, third-party claims, or property damage caused by the Renter or the equipment while in the Renter's possession.

4. Equipment Condition & Responsibility

The Renter acknowledges that they received the equipment in good working order and agrees to operate it according to all safety instructions and local regulations. The Renter remains fully responsible for the equipment until it is returned to and accepted by Go Rolling Waves.

5. Governing Law

This agreement is governed by the laws of the State of Florida. If any portion is found invalid, the remainder shall continue in full legal force and effect.

SMS / Text Message Authorization

Authorization to Contact by Text Message

By checking the box below, you ("Renter") expressly authorize Go Rolling Waves (GRW) and its representatives to contact you via SMS/text message at the phone number provided in this form. Text messages may include, but are not limited to: delivery confirmations, estimated arrival updates, pickup reminders, equipment notifications, and other communications directly related to your rental.

Message and data rates may apply. Message frequency will vary based on the status of your rental. Go Rolling Waves is not responsible for any charges incurred through your wireless carrier.

Opt-Out

You may opt out of receiving text messages at any time by replying STOP to any message from Go Rolling Waves. After opting out, you acknowledge that GRW may have limited ability to provide real-time delivery and pickup updates, and that service communications may be delayed.

Privacy

Your phone number will not be shared with or sold to any third party. It will be used solely for communications related to your Go Rolling Waves rental.

Delivery & Return
Service Windows: Mon–Fri 8 AM–4 PM · Sat–Sun 8 AM–2 PM. Deliveries guaranteed within a 2-hour window. Cruise port deliveries scheduled by check-in time, not port arrival.
⚠️ Important — Cruise Pickup Policy: All cruise line deliveries are self-pickup at the designated port location unless stateroom delivery has been prearranged with Go Rolling Waves at least 45 days in advance. Once you pass the main entrance for check-in and security, you may not be permitted to return to collect your rental. Do not proceed through security until you have your equipment in hand.
⚠️ Return Policy — $250 Fee Warning: All rentals must be returned outside at the predetermined pickup location. Failure to do so will result in a $250 Loss & Recovery Fee. This fee can only be avoided if an alternative return arrangement has been prearranged with Go Rolling Waves at least 45 days in advance.
🔋 Battery Care — Nightly Charging Required: All powered units must be plugged in and charged every night throughout your cruise to preserve battery health and ensure reliable performance each day. Failure to charge nightly may result in reduced range or loss of power. Charger and charging instructions are provided with your unit at delivery.
⚠️ Cruise Delivery Scheduling Notice: Go Rolling Waves schedules all cruise deliveries based solely on your verified check-in time as confirmed by the cruise line. The time entered on this form must match your official check-in time exactly — not your estimated arrival or preferred boarding time. Delivery requests that cannot be verified against your cruise line’s confirmed check-in documentation will not be accommodated.

⚠️ Hotel Delivery Policy — Please Read Before Proceeding:
  • All hotel deliveries are handed off directly to the front desk, concierge, or valet. Go Rolling Waves does not deliver to guest rooms.
  • You must have a verifiable hotel reservation on file. Deliveries cannot be completed without confirmed reservation details.
  • You are responsible for notifying hotel management of the incoming delivery and the item(s) being delivered prior to the scheduled delivery date. Failure to do so may result in delays or refusal of delivery.
  • All rentals must be returned to the front desk, concierge, or valet at the conclusion of your stay. Do not leave equipment unattended or in your room at checkout.
